– Effective date of Step 1 for smaller forced-air furnaces (those under 60,000 BTUs)
January 11, 2017
– The Relief from New Source Performance Standards (NSPS) Act (H.R. 453) is introduced by Congressman Collin Peterson (D-MN-07). The bill would extend the effective date of Step 2 of the NSPS by three years, from May 15, 2020 to May 15, 2023.

– House Committee on Energy & Commerce Subcommittee on the Environment holds a hearing to review H.R. 453 and other bills.
September 26, 2017
– Senate bill S. 1857, which is identical to H.R. 453, is introduced by Senator Shelley Moore Capito (R-WV).
November 14, 2017
– Senate Committee on Environment & Public Works Subcommittee on Clean Air & Nuclear Safety holds a hearing on S. 1857 and other bills.
November 15, 2017
– House Committee on Energy & Commerce Subcommittee on the Environment holds a markup session on H.R. 453 and other bills. H.R. 453 is moved out of the subcommittee for full committee consideration.
December 6, 2017
– House Committee on Energy & Commerce review H.R. 453 and move it out of committee for consideration by the full House of Representatives.
March 7, 2018
– H.R. 453 is voted on by the full House of Representatives and is passed on a bipartisan vote.
September 18, 2018
– Senate Committee on Environment & Public Works review S. 1857 and move it out of the committee for consideration by the full Senate.
November 30, 2018
– EPA publishes two packages: one is a Notice of Proposed Rulemaking (NPRM) proposing sell-through for certain appliances and the other is an Advanced Notice of Proposed Rulemaking (ANPRM) requesting feedback on a host of issues.
December 17, 2018
– EPA Public Hearing on Proposed Rule
January 14, 2019
– Comment deadline for Proposed Rule on sell-through
April 2, 2020
– EPA publishes a Final Rule in the
Federal Register
denying sell-through for Step 1 products.
May 22, 2020
– EPA publishes a Notice of Proposed Rulemaking in the
Federal Register
proposing sell-through for Step 1 products until November 30, 2020 due to the impacts of COVID-19.
June 8, 2020
– EPA holds a virtual public hearing on the COVID-19 sell-through proposal.
June 25, 2020
– HPBA files a brief with the U.S. Court of Appeals for the D.C. Circuit in our ongoing litigation with the Environmental Protection Agency (EPA) over issues in the 2015 NSPS. The case focuses entirely on one issue: audit testing.
July 6, 2020
– Comment deadline for EPA's COVID-19 sell-through proposal.
